These Terms & Conditions ("Terms") govern your use of webSIGHT Solutions's services and website at websightsolutions.com.my. By engaging our services or using our website, you agree to be bound by these Terms. Please read them carefully.

1. About Us

webSIGHT Solutions ("we", "us", "our") is a web design and development studio operated by Abraham Tan (business registration no. 202603073903 / AS0511978-K) and based in Johor Bahru, Malaysia. We specialise in building custom, high-performance websites for Malaysian SMEs and businesses. Our business email is [email protected].

2. Services

We offer custom website design, development, and related digital services. The specific scope of each project is agreed upon in writing (via email or a formal proposal) before work begins. Any additional work beyond the agreed scope will be quoted separately and requires your approval before proceeding.

3. Project Engagement

All projects are initiated upon receipt of a confirmation of scope and a deposit payment. Work commences only after the deposit is received. Project timelines are estimates and may vary depending on client feedback turnaround times and third-party dependencies.

• Projects begin only after receipt of the agreed deposit.
• Client is responsible for providing all required content (text, images, branding) by the agreed deadline. Delays in content provision may extend the project timeline.
• Each project includes a defined number of revision rounds as stated in the proposal. Additional revisions beyond the agreed rounds are chargeable.
• The final deliverable (hosted website) will be accessible upon receipt of the final payment.

4. Payment Terms

Payment terms for our Solutions Package are structured for simplicity and transparency. We require a 30% deposit of the total project amount upon project agreement and before work commences. The remaining balance (70%) is due upon project completion, prior to website launch and handover of final deliverables.

We accept payments via Curlec-powered methods including FPX online banking, credit/debit cards, Touch 'n Go eWallet, and other available online payment options. Late payments may result in project work being paused until payment is received.

5. Intellectual Property

Upon receipt of full payment, webSIGHT Solutions transfers ownership of the specific frontend visual designs and graphical assets created specifically for the project to the client. However, webSIGHT Solutions retains full ownership and intellectual property rights over all backend source code, underlying technology, proprietary logic, and technical frameworks used to develop the website.

We retain the right to display the completed work in our portfolio unless otherwise agreed in writing.

Third-party assets, fonts, stock images, plugins, or frameworks used in the project remain subject to their respective licences. It is the client's responsibility to ensure continued compliance with any third-party licence requirements after project delivery.

Any content, materials, or assets provided by the client must not infringe on any third-party intellectual property rights. The client indemnifies webSIGHT Solutions against any claims arising from client-supplied content.

6. Client Responsibilities

• Provide accurate, complete, and timely content and feedback.
• Ensure that all materials supplied (text, images, logos) are owned by you or properly licensed for use.
• Maintain the security of any login credentials provided for your website or hosting.
• Notify us promptly of any issues discovered after delivery.

7. Warranty & Support

We provide a 30-day post-launch support period for bug fixes directly related to our work. This warranty does not cover issues arising from client modifications, third-party plugin updates, hosting environment changes, or user error after handover.

Ongoing maintenance, hosting, or support beyond the warranty period is available as a separate service arrangement.

8. Limitation of Liability

To the maximum extent permitted by Malaysian law, webSIGHT Solutions's total liability to you for any claim arising from our services shall not exceed the total amount paid by you for the specific project giving rise to the claim.

We are not liable for any indirect, incidental, or consequential losses including lost profits, lost data, or business interruption arising from the use or inability to use our services or delivered products.

9. Termination

Either party may terminate a project engagement with written notice. In the event of termination, the client is liable for payment of all work completed up to the termination date. Deposits are non-refundable once work has commenced. See our Refund Policy for full details.

10. Governing Law

These Terms are governed by the laws of Malaysia. Any disputes arising shall be subject to the exclusive jurisdiction of the Malaysian courts.

11. Changes to These Terms

We reserve the right to update these Terms at any time. Changes take effect upon publication on this page. Continued use of our services after changes constitutes acceptance of the updated Terms.
